Welcome to the Club Champion Golf Ball Subscription Service (the “Service”). Please read these Terms and Conditions (“Terms”) carefully. These Terms govern your subscription and the recurring billing process for the physical products delivered to you. By subscribing to the Service, you accept and agree to be bound by these Terms, and you authorize Club Champion to charge your payment method on a recurring basis as set forth below.
1. Automatic Renewal and Recurring Billing Agreement
THIS IS AN AUTOMATICALLY RENEWING SUBSCRIPTION. BY SIGNING UP FOR THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBSCRIPTION HAS AN INITIAL AND RECURRING PAYMENT FEATURE AND YOU ACCEPT RESPONSIBILITY FOR ALL RECURRING CHARGES PRIOR TO CANCELLATION.
1.1 Express Consent and Authorization
You expressly authorize Club Champion (or its third-party payment processor) to charge your designated credit card, debit card, or other payment method (your “Payment Method”) for the price of your selected subscription package (the “Subscription Fee”), plus any applicable taxes, shipping, and handling fees.
1.2 Billing Cycle
The Subscription Fee will be billed at the beginning of the cycle corresponding to your chosen subscription frequency (e.g., Monthly, Quarterly, or Annually) until you cancel the Service in accordance with Section 4.
1.3 Price Changes
We reserve the right to change the Subscription Fee. We will provide clear and conspicuous notice of any price changes at least thirty (30) days before the new price is implemented. If you do not wish to continue your subscription at the new price, you must cancel before the new rate takes effect.
2. Payment and Billing
2.1 Payment Method Details
You must provide current, complete, and accurate information for your Payment Method. You are solely responsible for ensuring that your Payment Method is valid and up-to-date. If your payment information changes, you must update your Payment Method details immediately.
2.2 Declined Payments
If we are unable to charge your Payment Method (e.g., due to expiration, insufficient funds, or other issues), we reserve the right to suspend or terminate your access to the Service immediately. We may attempt to process the charge again. If payment is not successfully received within seven (7) days of the initial billing date, we may suspend your next shipment until payment is successfully processed.
3. Order Confirmation and Reminders
3.1 Initial Confirmation
Immediately following your enrollment, you will receive an email confirmation that includes these Terms, the amount of the initial charge, the recurring billing date/schedule, and clear instructions on how to cancel your subscription.
3.2 Renewal Reminders
For any subscription term, we will send you an electronic reminder notice between fifteen (15) and forty-five (45) days prior to the renewal date, clearly stating the upcoming charge amount, the length and terms of the renewal period, the method to cancel, and providing a direct link to manage or cancel your subscription.
4. Cancellation and Termination
4.1 Cancellation Mechanism
You may cancel your subscription at any time by: (a) logging into your account at ballfitting.ai and using the cancellation option in your account dashboard; or (b) sending an email to info@clubchampion.com.
4.2 Cancellation Deadline
To avoid being charged for the next billing cycle, you must cancel your subscription before 11:59 PM EST on the day preceding your scheduled billing date. Cancellations received after this deadline will result in a charge for the upcoming cycle, and you will receive that final shipment.
4.3 Effect of Cancellation
If you cancel, you will retain access to the Service (and receive any remaining pre-paid shipments) until the end of your then-current paid billing cycle. You will not be charged again thereafter.
4.4 Termination by Club Champion
Club Champion reserves the right to terminate your subscription immediately and without prior notice if you fail to pay any fees due or violate these Terms.
5. Returns and Refunds
5.1 No Refunds on Shipments
All sales are final. Subscription Fees are non-refundable, and there are no refunds or credits for partially used periods.
5.2 Defective or Incorrect Product
If you receive golf balls that are defective, damaged, or incorrect (not matching the product description for your subscription), you must contact us at info@clubchampion.com within ten (10) days of receipt. We will arrange for a replacement shipment at our cost.
6. Limitation of Liability and Disputes
6.1 Limitation of Liability
In no event shall Club Champion, its affiliates, directors, or employees be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your subscription or the use of the golf balls provided, exceeding the amount you paid for the subscription in the immediately preceding twelve (12) month period.
6.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
6.3 Dispute Resolution
Any dispute or claim relating in any way to your use of the Service will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
7. Miscellaneous
7.1 Entire Agreement
These Terms constitute the entire agreement between you and Club Champion concerning the Service.
